FIDIC / Legal Reference: Programme requirements under FIDIC Clause 8.3
The longest sequence of activities in a construction programme — the chain of tasks that determines the earliest possible completion date. A delay to any activity on the critical path delays project completion by the same amount. Only activities on the critical path are relevant to Extension of Time entitlement.
What it means in practice
Understanding the critical path is fundamental to delay analysis. Activities that have float can be delayed without affecting the completion date, provided the delay does not consume all available float. Activities on the critical path have zero float. When a delay event occurs, the first analytical question is whether it affects a critical path activity.
The critical path can shift during a project as delays are incurred and the programme is updated. An activity not originally on the critical path may become critical as other activities are delayed. This dynamic nature makes historical delay analysis complex and is the reason experienced delay analysts prefer the Time Impact Analysis methodology.
Where disputes arise
Disputes frequently arise over whether the contractor’s submitted programme was genuinely ‘accepted’ by the Engineer (contractually binding as the baseline) or merely ‘acknowledged’ (noted but not approved). If the programme is not accepted, establishing the true critical path for delay analysis becomes significantly more difficult.

UAE construction projects often involve complex multi-zone programmes with multiple interfaces between packages — particularly on large-scale infrastructure and mixed-use developments. The critical path in such projects requires specialist programme analysis to identify correctly.
