The multi-stage process of obtaining formal government and utility authority approval for a construction project in the UAE — covering town planning approval, external authority NOCs, and the municipality building permit. Authority approval delays are the most common employer-risk event giving rise to EOT claims in UAE construction.
What it means in practice
The authority approval workflow in the UAE typically follows three sequential stages: Stage 1 (Town Planning) — obtaining the planning approval and Affection Plan; Stage 2 (External Authority NOCs) — obtaining NOCs from utilities, telecoms, Civil Defense, and roads authorities; and Stage 3 (Municipality Building Permit / Bina’ License).
Each approval stage has its own submission requirements, review periods, and inter-dependency with the others. Design changes required by authorities — particularly for fire compliance, utility connections, or road interfaces — can have significant downstream impact on the construction programme.
Where disputes arise
Authority approval delays give rise to EOT claims where: the employer is responsible for making the approval submissions; the authority’s review period exceeds what was reasonably anticipated; or authority-required design changes constitute Variations that affect the construction programme.
UAE Context
Different UAE Emirates have different authority approval processes. Dubai uses the Bina’ portal system; Abu Dhabi uses the Tasheed platform; Sharjah has its own Town Planning and Building Permit process. Contractors working across Emirates must understand each authority’s specific requirements.
