Last updated: 26/04/2026
This Disclaimer applies to all content published on www.e-basel.com (“the Site”), including articles, insights, pillar guides, case studies, lead magnets, templates, and any other written or visual material. Read it carefully before relying on Site content.
The essential point
The content on this website is provided for general informational purposes only and does not constitute legal advice, expert opinion, formal expert evidence, or professional consultancy on any specific matter.
Users should not act, or refrain from acting, on the basis of any information on the Site without obtaining advice from a UAE-qualified legal practitioner or relevant professional engaged on the facts of their particular matter.
1. General disclaimer
E-Basel publishes content on FIDIC contracts, UAE construction law, arbitration procedure, claims methodology, project management, and related professional topics. The content reflects the author’s analysis at the date of publication and is not updated continuously. UAE law, FIDIC editions, institutional rules, and industry practice change over time. Content current at the date of writing may not be current at the date of reading.
2. Not legal advice
Eng. Mohamad Basel Al Najjar is a Civil Engineering Consultant, DIAC Arbitrator, Tribunal Chairman and Accredited Expert Witness. He is not a UAE-qualified legal practitioner. Site content is not, and is not intended to be, legal advice.
For any matter requiring an opinion on UAE law, the interpretation of a contract under UAE law, or the conduct of proceedings before a UAE court or arbitration institution, you should engage a UAE-qualified legal practitioner. E-Basel is happy to refer matters to suitable practitioners on request.
3. Not formal expert evidence
Although the author is an accredited expert witness, the views expressed on the Site are personal commentary and educational analysis. They do not constitute formal expert evidence, an expert report, or a sworn opinion in any proceedings.
Formal expert evidence from E-Basel arises only on:
- Receipt of a letter of instruction from a party or counsel.
- Completion of conflicts and independence checks.
- Execution of an engagement letter.
- Issue of a written report or testimony in compliance with the applicable procedural rules (CPR Part 35, IBA Rules, or equivalent).
4. Not an arbitral or tribunal opinion
Where Site content discusses arbitration procedure, awards, or institutional rules, the analysis is offered in the author’s capacity as an educator and commentator. It is not, and must not be relied upon as, the opinion of any arbitrator, tribunal, or arbitral institution.
In any matter in which E-Basel is appointed as arbitrator or member of a tribunal, the only authoritative statement of the tribunal’s view is the procedural orders, partial awards and final award issued in that matter.
5. No professional relationship
Reading Site content, downloading lead magnets, subscribing to updates, or making contact through the Site does not create a consultant-client, expert-client, arbitrator-party, or any other professional relationship between you and E-Basel. A professional relationship arises only on execution of a written engagement letter.
Until an engagement letter is executed, no information you share through the Site is treated as confidential matter information, and E-Basel may decline to engage on the matter for conflict, capacity, or other reasons.
6. Accuracy and currency
E-Basel takes reasonable care in the preparation of Site content. However, no warranty is given that content is complete, accurate, current at the date of reading, or applicable to the reader’s specific facts. Where case law or legislation is cited, citations should be verified against the original source before reliance.
7. External references
Where Site content references external sources — case law, FIDIC publications, SCL Protocol, AACE recommended practice, institutional rules — the references are provided for educational purposes. E-Basel does not represent any external organisation and is not responsible for the content or availability of external sources.
8. Limitation of liability
To the maximum extent permitted under UAE law, E-Basel accepts no liability for any direct, indirect, incidental, consequential, or special loss arising from reliance on Site content. Refer to our Terms of Use for the full liability provisions.
