FIDIC / Legal Reference: UAE regulatory framework
A formal approval issued by a UAE authority confirming that the authority has no objection to a proposed development, connection, or activity. NOCs are required from multiple authorities at different stages of a construction project. Employer delays in obtaining NOCs are a major source of contractor EOT claims in the UAE.
What it means in practice
NOC requirements in UAE construction span the entire project lifecycle: Town Planning NOC, building permit NOCs from external authorities (utilities, telecoms, roads, aviation), authority inspection NOCs during construction, and completion NOCs before an operational permit is issued.
Under FIDIC, the allocation of responsibility for obtaining NOCs depends on the contract’s particular conditions. In most UAE contracts, the employer is responsible for obtaining planning and building permits. Where the employer’s failure to obtain a required NOC delays the contractor’s work, this constitutes an employer-risk event giving rise to EOT entitlement.
Where disputes arise
NOC delay claims are among the most common — and most contested — contractor claims in UAE construction. Employers routinely argue that NOC delays were caused by the contractor’s own failures rather than employer default. Systematic documentation of NOC submission and response dates is essential evidence.
