Baseline Programme

FIDIC / Legal Reference: FIDIC Red Book Clause 8.3

The initial construction programme submitted by the contractor at the start of the project, which records the planned sequence and timing of all activities. The baseline programme is the reference point against which all subsequent delay analysis is conducted — its quality and contractual status are critical to the outcome of delay claims.

What it means in practice

Under Clause 8.3, the contractor is required to submit a detailed programme within 28 days of receiving the Letter of Acceptance. The programme must show the order and timing of all activities, the methods the contractor intends to use, and the resources to be deployed. A distinction must be drawn between the Engineer accepting the programme and merely acknowledging receipt.

A programme accepted by the Engineer becomes a contractual document — the baseline against which delay is measured. Where the Engineer has neither accepted nor rejected the programme, tribunals sometimes treat silence as acceptance — but this is not a universal rule.

Where disputes arise

Disputes over whether the submitted programme was ‘accepted’ or merely ‘acknowledged’ are a recurring feature of UAE construction delay claims. UAE construction projects frequently suffer from incomplete or over-optimistic baseline programmes submitted to meet the contractual deadline rather than to reflect realistic construction methodology.
